Current DACA Application Policies: A Quick Guide

In June of 2020, the Supreme Court overruled attempted legislation from the President Trump administration that sought to terminate the Deferred Action for Childhood Arrivals act (DACA).


This act was originally put in place to protect the rights of immigrants who entered America under unlawful circumstances as children by allowing a renewable two-year period of protection from deportation and eligibility for a work permit in the United States.

Unfortunately, despite the Supreme Court’s overruling, the Department of Homeland Security decided to stop accepting any new applications related to this act until a federal court judge sent out an order for the organization to resume taking applications in early December of last year.

With this matter being settled, any immigrant who entered the U.S. while they were under the age of 16 and have continuously resided in the U.S. since 2007 can now safely complete an application for DACA protection again. What are the requirements for DACA status?

Any immigrant is eligible to apply for DACA status so long as they meet the following requirements laid out by the U.S. Citizenship and Immigration Services government division:


1. Individual must have been under the age of 31 as of June 15, 2012.

2. Individual arrived in the United States before reaching their 16th birthday.

3. Individual has continuously lived in the United States since June 15, 2007, and up to the present date.

4. Individual was physically present in the United States on June 15, 2012, and was actively working on making a request for consideration of deferred action with USCIS.

5. Individual had no lawful status on June 15, 2012.

6. Individual is currently in school, or has graduated or earned a certificate of completion from high school, or has obtained a general education development (GED) certificate, or is an honorably discharged veteran of the Coast Guard or Armed Forces of the United States.

7. Individual has not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and does not otherwise pose a threat to national security or public safety.

There has been some confusion surrounding item #6 from the above list. So long as you are actively working on a GED, you may be eligible for DACA status.
